These Terms of Service ("Terms") govern your access to and use of the LaunchBuoy platform operated by Launch Buoy LLC ("we," "us," or "our"). By using LaunchBuoy, you agree to be bound by these Terms.

1. Account Registration

To use LaunchBuoy, you must create an account. You agree to:

Provide accurate and complete information.
Maintain the security of your account credentials.
Use one account per person.

2. Free Tier Eligibility

Free use of LaunchBuoy is restricted to individuals and companies with annual gross revenue under $80,000 USD. Users or companies exceeding this threshold must upgrade to a paid plan.

Launch Buoy LLC reserves the right to verify eligibility and terminate free access if the revenue threshold is exceeded.

3. Acceptable Use

You agree not to:

Use the service for any illegal purpose.
Interfere with or disrupt the service or its infrastructure.
Attempt unauthorized access to any systems or data.
Scrape, crawl, or use automated tools to access the service without permission.
Impersonate any person or entity.

4. Intellectual Property

Your content: You retain all rights to the data and content you submit to LaunchBuoy. We claim no ownership of your content.
Our platform: The LaunchBuoy platform, brand, software, and design are the property of Launch Buoy LLC.
License to us: You grant Launch Buoy LLC a limited license to host, display, and process your data solely as necessary to provide the service.

5. Account Termination

You may delete your account at any time.
We may suspend or terminate accounts that violate these Terms.
Upon termination, your data will be deleted in accordance with our Privacy Policy.

6. Limitation of Liability

The service is provided "as is" and "as available." Launch Buoy LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

Our total liability to you is limited to the amount of fees you paid to us in the 12 months preceding the claim.

7. Disclaimer of Warranties

We make no warranties, express or implied, regarding the service, including but not limited to:

No guarantee of uptime, availability, or uninterrupted service.
No warranty of accuracy, completeness, or fitness for a particular purpose.
No warranty that the service will meet your specific requirements.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.
